At Kat's Wills and Estate Planning, I understand the importance of preparing for the future.
Creating a will and having the best estate planning in place is essential for everyone, no matter the size of your estate because everyone should have their say about what happens to their estate. Without a Will or properly advised estate planning in place then what happens with your estate when you die is dictated by Intestacy Law which is a severely outdated law that has little or no place in todays I provide professional, friendly, and affordable will writing and estate planning services to ensure your wishes are respected and your loved ones are taken care of when you are no longer here. Let me help you plan for the inevitable and give you the peace of mind that everyone will be looked after exactly how you want them to be.

What is Estate Planning?
Estate planning refers to the process of organizing a person’s affairs to manage what happens to their money, property, and possessions (their "estate") after they die or if they lose mental capacity.
While the core principles are similar to those in other countries, England has its own legal system and tax rules, so the specifics differ.

Key Elements of Estate Planning:

1. Making a Will
-
A legally binding document that sets out how your estate should be distributed.
-
You can name executors, beneficiaries, and guardians for minor children.
-
If you die without a will (intestate), your estate will be distributed under the rules of intestacy, which may not reflect your wishes.

2. Inheritance Tax (IHT) Planning

-
Inheritance Tax is typically charged at 40% on estates over the £325,000 threshold (nil-rate band).
-
Planning strategies can include:
-
Gifts made during your lifetime (subject to 7-year rule)
-
Using trusts
-
Leaving 10% or more of your estate to charity (can reduce the IHT rate)
-

3. Lasting Powers of Attorney (LPA)

-
There are two types:
-
Property and Financial Affairs LPA
-
Health and Welfare LPA
-
-
These allow someone you trust to make decisions on your behalf if you lose mental capacity.

4. Trusts

-
Legal arrangements where assets are held by trustees for the benefit of others.
-
Common for asset protection, tax planning, or supporting vulnerable beneficiaries.

5. Joint Ownership

-
How property is held jointly can affect how it passes on death:
-
Joint Tenants: The property automatically passes to the other owner.
-
Tenants in Common: Each share is passed via the will or intestacy.
-

6. Beneficiary Nominations

-
Certain assets (e.g. pensions, life insurance) pass outside the will if a beneficiary is nominated.

7. Funeral Wishes & Letters of Wishes

-
Not legally binding, but helpful guidance to your executors and family.
Why Estate Planning Is Important:

-
It can help avoid delays and minimise costs of probate.
-
It can help minimise inheritance tax liability.
-
Ensures dependents are provided for.
-
Avoids disputes among heirs.
-
Gives you control over medical and financial decisions if you lose capacity.

Katrina Conway, Your Local Will Writer and Estate Planner in Newcastle upon Tyne and online or remotely across the United Kingdom.
I'm Kat, a Will Writer and Estate Planner living in the Newcastle Upon Tyne area. I graduated from Northumbria University in 2015 with a 2:1 MLaw Exempting degree, a Masters Level degree in Law. During my degree, my specialities were Wills, Estate Planning and the Administration of Estates. I am now a professional will writer and estate planner with over 9 years of experience.
I am a member of the Society of Will Writers because although Estate Planning is not a regulated industry I believe my customers should expect the same level of service from myself as they would receive from a solicitor. As a result I have chosen to be regulated and governed by becoming a member of The Society of Will Writers. I have underwent training and examination to ensure I know what I am doing prior to becoming a member. Additionally I have chosen to adhere to their Code of Conduct and ensure I have professional indemnity insurance in place to ensure all of my customers are in safe hands when they choose to put their trust in me.
I chose to become a Will Writer and Estate Planner because I firmly believe everyone should have a will in place for when they die. It does not matter what the size of the estate is - everyone should be able to determine how their estate is distributed when the time comes. As a result I want to offer professionally drafted and easy to understand wills and estate planning services at an affordable price for all.
